All Items Must be paid for within 24 hours of the auction.
All vehicles purchased must be paid by cash, debit, or bank draft. A maximum of $1000 deposit can be put on your credit card.
Vehicle Payment Terms:
1.Vehicles are charged a maximum of $750 buyers premium.
2.Vehicle purchases over $3500 will be paid by debit, cash or bank draft Only, (credit card payments will not be accepted over this amount)
-All items need to be picked up within 5 days of purchase.
-All items left after that time are subject to a $6 per day per item storage fee.
-All items left for 21 days or longer are considered forfeited.
-No refunds will be issued for forfeited items.

Live auctions will be subject to a 5% buyer's premium (unless otherwise noted). A
Online bidding during the Live Auction is a fast process; therefore, there is no confirmation given - bids will be taken immediately and are irrevocable.
The highest bidder shall be the purchaser upon the completion of bid verification. Bid verification will commence upon the conclusion of a live auction and may last 24 hours. All winning bidders shall be notified by email within the 24-hour bid verification period.
No bidder shall retract their bid. In the event of a dispute between two or more bidders, the auctioneer, at his sole discretion, may put the lot up for resale to the highest bidder.
A bidder is deemed to have accepted an item when making a bid.
The auctioneer reserves the right to withdraw any lot at any time before the sale of such a lot.
The auctioneer reserves the right not to accept any bid which is only a partial advance over the preceding bid.
The auctioneer may break down or consolidate any lot or lots at his sole discretion.
Kastner Auctions Limited assumes no responsibility for any liability once a bid is accepted. It is recommended that purchasers arrange insurance for their purchases in advance.
Except as set out herein, there shall be no warranties or guarantees expressed or implied, statutory or otherwise of any nature.
Please take advantage of the in-person preview as all items are sold "As Is, Where Is" - catalogues are prepared only as a guide. No sale shall be invalidated by any reason, defect, or inaccuracy of description in catalogue or otherwise, and the auctioneers shall bear no liability by virtue of any such fault or error. All sales final.
Attendance at the auction, preview, or removal by bidders and guests is done at their sole risk. Kastner Auctions assumes no risk or liability, statutory, common law or otherwise, for the safety of those attending the auction premises.
All lots must be paid for on the day of sale by Money, cash or credit card where acceptable. Internet bidders shall have within 24 hours of receiving their email notification to pay for their items.
All applicable excise and sales taxes shall be added to the purchase price.
The purchaser is not entitled to possession until all items have been paid for in full. If the purchase prices are not paid within the prescribed time, the auctioneer shall have the right to resell such items in whatever manner he sees fit without notice to the purchaser. The purchaser shall pay any shortfall from sale plus commission and expenses thereof.
All costs and responsibilities of removal shall be borne by the purchaser/bidder within the time prescribed by the auctioneer. The auctioneer may require proof of adequate insurance from the purchaser. The purchaser/bidder hereby indemnifies the auctioneer and the vendor against any damages arising from the dismantling and removal of any lots.
Any lots not removed within the prescribed time shall be subject to storage, moving, disposal and service charges at the sole risk and expense of the purchaser. All such lots shall be deemed as abandoned and shall be subject to resale for the recovery of such charges. The purchaser shall also be liable for any rent or damages sustained by the auctioneer for failure to remove any lot.
Suppose, for any reason, Kastner Auctions Ltd cannot deliver any or all of an awarded lot or title thereof. In that case, the sole liability of Kastner Auctions Ltd shall be the refund of any monies paid on the lot.
1. UNRESERVED: The seller has agreed to accept the highest bid regardless of price. The Property will sell to the highest bidder without minimum or reserve.
2. NO WARRANTY: The Buyer shall accept the Property as-is where-is and expressly agrees that neither the Seller, Auctioneer or Realtor makes any representations or warranties of any kind as to the condition or fitness of the Property, environmental or otherwise, or any improvements thereon.
It is the responsibility of all bidders to review all information provided. Bidders shall have satisfied their descriptions, location, and condition before bidding. If you need clarification, it is the bidder's responsibility to obtain clarification from Real Estate Brokerage.
3. GST: The bid price does not include any applicable GST unless announced otherwise by the auctioneer.
4. DEPOSIT: Immediately at the close of bidding, the successful bidder will make a NON-REFUNDABLE deposit payable to the real estate brokerage (as listed in the Property Information Package) in the form of a bank draft or other approved payment. The amount is listed in Property Info Package/or as announced by the auctioneer.
5. PURCHASE CONTRACT: The Real Estate Purchase Contract that applies to each Property will be available for inspection before the auction. Title(s) will be clear of encumbrances except those to remain on the title. All bidders agree that, should their bid be accepted, they will complete and be bound by the terms of the purchase contract. Buyers will pay the balance of the purchase price to their lawyer on or before Completion Day. Possession will be by the terms of the Purchase Contracts.
